Holland Conservation Commission

Minutes of Commission meeting held on June 13, 2006.

Present: Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, Ann Hall and Rolf Hilbig.
Absent: Howard Fife and James Wettlaufer.

7:00 p.m. Chairperson called the meeting to order.

7:05 p.m. Minutes of Commission Meeting held on June 6, 2006 were read, accepted and will be distributed.

Old Business:

Received from Madeiros Consulting LLC a Request for Determination of Applicability for a project at Lot 5, Mashapaug Rd. Both Mary vandenBerg and Howard Fife spoke with John Madeiros informing him that he would require a Notice of Intent because his new construction is in the Buffer Zone.

Since the Enforcement Order sent on June 6, 2006, the DEP and Howard Fife, Agent have visited with Mr. LaMountain at his Mashapaug Rd. property – Mr. LaMountain has informed us that he will present his case to the HCC tonight.

The Holland Board of Selectmen will receive nominations for the HCC for their approval of the following nominees:
Howard Fife - three-year term beginning July 1, 2006, ending June 30, 2009
Ann Hall - three-year term beginning July 1, 2006, ending June 30, 2009

Lycott will be seeding the lake for Milfoil on 6-14-2006. Notices were posted by the HRA and placed on Cable.
7:30 p.m. Joseph Frigo’s Public Hearing of a Notice of Intent to re-construct stone walls, deck and add a second story at 12 Julie Ann Dr., DEP File #184-0203 was held. Present were Joseph Frigo and RJ Parron, general contractor. Following discussion motion was made to accept the project. Motion accepted and all parties were in favor of closing the hearing at 7:55 p.m. RJ Parron gave us a check for $50.00 paying for the Legal Ad and $67.50 paying for the Notice of Intent filing fee.

8:00 p.m. Chad Brigham of Northeast Concepts, Inc. and James LaMountain came in response to the Enforcement Order issued by the HCC on June 6, 2006. They requested recording the proceedings and we approved. Mr. LaMountain gave us a Sealed document regarding Huguenot Farms, Inc. which explains his intent to develop the property. He spoke of meeting with Roberta K. Baker, Regional Planner of the DEP, Western Region. Mary vandenBerg referred to a letter sent February 17, 2006 to Chad Brigham stating that “you may be in violation of Chapter 131 of the M.G.L. Wetlands Protection Act. There is activity within the 200’ Buffer Zone of Amber Brook which falls under the protection of this Act as a Riverfront Area.’’ Mr. Brigham did visit the HCC in that regard and was made aware that the HCC did not consider the old cart path by Amber Brook to be a road and any work to be done within the 200’ Buffer Zone must come to the HCC before any work could be started. Mr. LaMountain maintains that an agricultural development does not require a Request for Determination and would not honor the Enforcement Order.

8:30 p.m. Mr. John Robbins of 29 Stafford Rd. spoke of his concerns with Mr. Dennis Shaffer’s blasting near his property and questions whether he got permission to cross his neighbor’s property to cut and take out trees. Steve Anderstrom made a motion to send a letter requesting Dennis Shaffer to visit the HCC to explain his actions. Motion approved by all.
